E-Cigarettes Exempted from Kentucky’s Tobacco Taxation Laws

Indeed news to celebrate upon, isn’t it? But it’s no advertisement gimmick or a scam promise by some e-cigarette manufacturer. The Tobacco Taxation Laws in Kentucky, in its latest amendment, has exempted e-cigarettes from tax. This means e-cigs aficionados can now have their favorite stuff at much discounted prices, since high doses of taxes will not be levied on it.

According to reports published by the Kentucky Department of Revenue, electronic cigarettes will not be incorporated under the category of “Other Tobacco Products,” hence, exempting e-cigs from any additional taxes that are imposed on cigarettes and other tobacco-containing products. The decision was executed as a result of an amendment to KRS 138.130 of the Kentucky Tobacco Taxation Law.

The amendment was passed as a result of a Parliamentary motion seeking to exempt e-cigarettes from tobacco taxes, since it only simulates the act of smoking and does not actually contain tobacco. The parliament, hence, instructed the Kentucky state council to abolish any such tax. As a result, electronic cigarettes will no longer be deemed to be a tobacco substitute, and thus, will not be subject to taxation.

According to definitions provided in Tobacco Taxation Law 138.130, “other tobacco products” refers to “Cigars, cheroots, stogies, periques, granulated, plug cut, crimp cut, ready rubbed, and other smoking tobacco; Cavendish, plug and twist tobacco, fine-cut, and other chewing tobacco; or Shorts, dry snuff, refuse scraps, clippings, cuttings and sweepings of tobacco;  other kinds and forms of tobacco prepared in a manner to be suitable for chewing or smoking in a pipe or otherwise, or both for chewing or smoking.

As per the definitions, electronic cigarettes don’t fall under any of the categories mentioned therein, and therefore, Kentucky state law declared that e-cigarettes will exempted from any additional tax that is levied for being in the category of “other tobacco products.” While the news is indeed exhilarating for e-cigs manufacturers and smokers, it is a matter to consider how this new amendment will benefit the consumers.

Kentucky tobacco taxation law exempting electronic cigarettes from the category of “other tobacco products” and hence, any further taxation, proves that e-cigarettes are 100% free from harmful tobacco components, and only provides a simulation of true cigarette smoking experience. Being exempted from taxes, consumers can now enjoy remarkably lower prices for electronic cigarettes as well. According to experts, this will boost the awareness and demand for e-cigarettes, which is set to go a long way in promoting the “health” side of smoking electronic cigarettes.
